Airbag injures driver, investigation launched

A driver of a new 2012 Hyundai Elantra filed a complaint with the National Highway Traffic Safety Administration after he says his side-curtain airbag sliced his ear in half after it deployed in an accident.

When the airbag deployed, a metal bracket also came apart and hit the driver in the head. Representatives at Hyundai say they have not received any other reports of side-curtain airbag injuries in the 2012 Elantra.

The NHTSA and Hyundai will both conduct an investigation into the accident. The 2012 Elantra, the automaker’s second-best selling car, was recently named the North American Car of the Year.

Nursing home owner charged with fraud

The owner of three Georgia nursing homes has pleaded guilty in Atlanta to Medicare and Medicaid fraud. The owner and his wife used $32.9 million of government money to buy luxury cars, homes, and vacations while conditions in the nursing homes became almost unlivable.

An FBI investigation discovered the nursing homes were significantly understaffed after the owner wrote bad checks to many employees. The ones who stayed were not given health insurance and were left with unpaid medical bills.

The owner also did no pay for trash disposal, janitorial cleaning, nursing supplies, or pharmacy and clinical laboratory services. Many employees cleaned the patients’ clothes at their homes and brought in their own food. The three facilities have since been shut down.

Two bicyclist fatally struck by van

Two cyclists were killed and one was injured last week on U.S. Highway 17 near Darien after a van struck them from behind. The two men were identified as 48 and 47 year-old men from Florida who were on their way back home from Washington, D.C.

According to family members, the men were all avid and experienced cyclists. One relative claims that one of the deceased men was wearing an orange safety vest, a helmet, and had lights on the front and back of his bike.

The Georgia State Patrol says the deadly accident is still under investigation. The driver of the van has been identified and so far no charges have been filed.

NFL lawsuits change due to Easterling’s suicide

In the wake of Ray Easterling’s suicide, the personal injury lawsuit he and seven other former NFL players filed against the NFL will now be changed to a wrongful death case, said Easterling’s lawyer.

Easterling and his colleague’s lawsuit was the first wave of more than five dozen of its kind filed against the league for what they say is negligence, intentional misconduct, carelessness, and concealment of information regarding the long-term health effects of concussions.

Easterling was a safety for the Atlanta Falcons from 1972 to 1979. The 62 year-old was found dead in his Virginia home from a self-inflicted gunshot wound.

Boy killed running to catch school bus

An 11 year-old Locust Grove boy was hit and killed Thursday morning as he was running across the street to catch the school bus. The 57 year-old driver of the vehicle stopped and called 911. The boy was a student at Locust Grove Middle School.

The boy was unconscious when he was airlifted to Atlanta’s Egleston Hospital in critical condition. He died about four hours later. Georgia State Patrol have not said whether or not the driver will face charges.

Investigators at the Henry County Sheriff’s Office are trying to determine whether or not the bus driver had followed proper procedure by turning on the bus’ flashing safety lights.

Toy truck recalled for potential fire hazard

Toy trucks sold with the purchase of Big Movers T-shirts at Kohl’s have been voluntarily recalled after one reportedly caught fire and three others began to smolder, announced the U.S. Consumer Product Safety Commission.

The toy is battery-operated and can smolder or catch on fire, creating a burn hazard. Fortunately, no injuries have been reported. About 9,000 Big Movers T-shirts were sold at Kohl’s stores between February and March. The truck is blue and about four inches long with over-sized tires.

Happy Shirts, the toy and shirt maker, urge consumers to stop using the toy immediately. Consumers can contact Happy Shirts directly for directions on how to receive a refund.

Mother sues hospital, nurse after baby loses finger

A 15 year-old mother from Tampa Bay, Florida has filed a lawsuit against a nurse and the Heart of Florida Regional Medical Center for negligence after her then three month-old daughter’s finger was cut off. The child was taken to the hospital  last October after running a high fever when the accident occurred.

The baby had to stay in the hospital for three days and had to have an IV in place. It was when the nurse was cutting the IV tape to remove the tube that she accidentally cut off part of the girl’s pinky finger with scissors. Surgeons tried to reattach the finger, but the nerve endings were too small.

The young mother and her lawyer claim the nurse acted negligently and the hospital had failed to properly train its staff.

Woman dies after clothes became stuck in escalator

An elderly woman died last week after her clothing became entangled in an escalator, strangling and eventually choking her to death. Investigators have ruled her cause of death as asphyxiation. The fatal accident happened in a Long Island Rail Road station in Lindenhurst, New York.

According to officials at the Long Island Rail Road Station, the escalator was in good working order and had been inspected in February. The escalator has been blocked off and out of order as the investigation continues. So far, investigators are not sure how her clothing became entangled.

Family members say the 88 year-old woman was on her way to visit her daughter who lived near the station.

Former UGA tight end arrested for DWI

Orson Charles, 21, was arrested in the early morning hours last Friday on suspicion of drunk driving in Athens. Charles, who has left the University of Georgia in his junior year, is expected to be a popular draft pick for the NFL.

Charles was arrested by the Athens-Clarke County police and released on bond a few hours later. His blood alcohol content was measured at 0.95 and 0.100, just above the legal limit of 0.08.

The tight end was a 2011 first team All-American selection, a John Mackey Award finalist, and lauded by Sports Illustrated Magazine. Charles is considered to be the number one tight end in his class and many do not expect his arrest to affect his draft status.

Goodyear recalling 41,000 tires

Goodyear Tire & Rubber Co. has announced that it will be recalling nearly 41,000 of its Wrangler Silent Armor tires, warning that a small number of the tires could tear and possibly result in car accidents.

A fatal rollover accident in west Texas last August that claimed the lives of two college students sparked the recall, although Goodyear claims external factors caused the tire damage. Wrangler Silent Armor tires, made in 2009, are used only on vans, pickup trucks, and SUVs.

Six different sizes of the tires made between March and June 2009 are the subject of the recall. Goodyear will start sending customers notices by March 22 and will replace the tires.
