Family files wrongful death suit against county after shooting

A family is suing Glynn County after a man was fatally shot by a police officer in the county. The family is claiming that the officer and  police chief violated the mentally ill man’s rights.

The man was legally drunk and taking medication for bipolar disorder that should not be mixed with alcohol and was angry with police at the time. The police officer shot the man to death at his home in September 2009.

Officers saw the man had weapons and he made multiple threats that he was going to kill the police officers.  The confrontation started over an illegal yard sign. The family of the man has filed the suit that claims that the police officers used “excessive force” which lead to the man’s wrongful death.

Wrongful death suit filed against Georgia nursing home

The owner of a Georgia nursing home has recently had a wrongful death suit filed against him by a family whose family member died allegedly of nursing home abuse.

The complaint was brought by a daughter whose father died after suffering a number of falls and fractures at the nursing home in 2007. The suit states that the family was not notified when the falls occurred and that her father died of malnutrition and dehydration.

It is an obligation of a nursing home to do their best to lessen the risk of nursing home residents falling because residents at a nursing home are more prone to fall. The nursing home that is involved in the suit has since been shut down after inspectors found a host of problems.

Wrongful death case settled in Georgia

The Georgia Department of Transportation has settled a wrongful death case with the family of a woman who was killed after a taxi cab drove off the side of the road and struck a tree.

The Georgia DOT will pay $600,000 to the family of the woman and also expressed their apologies to the children and husband of the woman. The accident occurred in 2003 as the woman was picked up by a cab at the airport and was on her way to a business trip when the cab driver lost control on the slick roadway. The woman was killed instantly.

The lawsuit claimed that the tree that the cab struck was put to close to the roadway and that the Georgia DOT was negligent when designing that area of the highway. The suit was put off for many years and finally went to trial when the lawsuit added that the section of the intersection was too steep and had a bad drainage system. DOT is planning to cut down more trees by the interstate as well.

Man killed in tragic motorcycle accident

A crash that occurred early this morning has left one dead, and charges filed against the other.

Happening some time around 2 a.m., the incident took place near 17th Street on the downtown connector.

According to the police report, the motorcyclist was struck by an allegedly drunk SUV driver from behind. The motorcyclist was identified as a man 50 years of age from Kennesaw, Georgia. The name of the other driver was not released by the police. That driver is being charged with driving under the influence and first-degree vehicular homicide. The Atlanta police spokeswoman addressed the media earlier today.

The Fulton County Medical Examiner’s office was responsible for properly identifying the man.

The tragic accident caused the northbound lanes heading onto I-75 to be closed until 4:30 this morning. It has yet to be announced whether a civil suit will be filed against the driver of the SUV as well.

Atlanta man dies, two injured in truck accident

On the southbound lanes near the 14th Street exit in Atlanta, a 22 year-old motorist hit a dump truck, killing the driver at the scene. Two passengers were injured in the car crash.

The accident occurred after 5 a.m. on Sunday. The truck was involved with the construction crews working on a repaving project taking part in that connector’s area downtown. The driver of the truck was not injured, but the two passengers in the Jeep Patriot that hit the construction vehicle were both severely injury. They are currently in critical condition after being taken to Grady Memorial Hospital.

Man found dead in RV fire

A 62-year-old man was found dead inside a camper when firefighters responded to a fire in Johns Creek, Ga., authorities said. Fire broke out around 1 a.m. Wednesday in the recreational vehicle, which was parked behind a brick house, authorities said. The man, identified as the homeowner, died before firefighters arrived.

Firefighters have not yet determined the cause of the fire, but investigations were expected to continue Wednesday. A propane tank was found attached to the RV, but firefighters do not yet know if it was being used at the time of the accident.
