Georgia court reaffrims medical malpractice decision

The Georgia court of appeals has recently reaffirmed a decision regarding an a woman who is suing after a an alleged negligent surgery. The appeals court upheld a decision that a plaintiff’s expert had not been in the field for three of the five years before the incident in question and that he was at fault.

The complaint stated that there was medical negligence when a woman had a cystoscopy surgery following a hysterectomy. The complaint also said that the woman underwent too many surgeries in short amount of time and that physicians failed to refer her to a more skilled doctor.

The court decided that although the doctor was very experienced, he was not an expert in the field and should not have done the surgery.
